Terms and Conditions

1.Photography Contract

It is agreed that the terms set out in this document will be the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing

​

2. Deposits

In the case of Wedding/Event photography, a non-refundable deposit of 50% of the total contract value is payable to Meg Cahill Photography along with a completed booking form in order to secure the booking, booking cannot be assumed until this deposit and form are received.

 

3. Special Requests/Coverage

The client understands and accepts that the photographic coverage will be as Meg Cahill’s professional expertise determines and that no one photograph will be deemed more important than another. Special requests are not considered binding instructions, although every effort will be made to accommodate the client’s wishes.

Any special requests not notified at the time of booking must be made clear by the client to Meg Cahill Photography in good time to allow any preparation.

4. The Photographer

On rare occasions, it may be necessary for Meg Cahill to be substituted by another professional photographer (e.g., due to illness or unforeseen circumstances)

5. Images

All image sizes are approximate. While every effort is made to ensure accurate colour balance, exact matches cannot be guaranteed due to variables such as fabric dyes and lighting conditions.

6. Additional Retouching

Additional retouching beyond that provided at Meg Cahill Photography’s discretion in the production of the images supplied, including digital manipulation and artistic finishing, is available to the client as an optional extra and is chargeable at the discretion of Meg Cahill Photography.

7. Copyright

​All images are protected under the Copyright, Designs and Patents Act 1988. It is unlawful to reproduce, copy, or distribute any image without written permission from Meg Cahill Photography.

​

8. Negatives/Digital Files

Original digital files remain the property of Meg Cahill Photography.

​

9. Licence

Meg Cahill Photography retains full artistic discretion regarding poses, locations, and final image selection. While every effort will be made to capture requested shots, this cannot be guaranteed due to weather, timing, or cooperation of subjects.

10. Force Majeure or Act of God

The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.

​

11. Previews

While Meg Cahill Photography aims to provide a generous selection of preview images, no specific number is guaranteed.

​

12. Display

Unless requested otherwise, the client agrees that Meg Cahill Photography may use images for portfolio, promotional materials, or social media.

​

13. Cancellation

For Weddings/Events, the client may cancel the contract at any time by giving written notice to Meg Cahill Photography. In doing so, the client shall forfeit the non-refundable deposit of 50% of the total contract value.

  • If cancellation is received more than 6 months prior to the Wedding/Event date, all other monies paid (excluding the deposit) will be fully refunded.

  • If cancellation is received within 3 months of the Wedding/Event date, no refund will be given.

  • If cancellation is received less than two weeks prior to the Wedding/Event date, no refund will be given. The client shall, in addition, pay a sum equal to 50% of the contract value. This sum shall be payable as compensation and is an estimate of the loss Meg Cahill Photography would suffer.

 

14. Limitation of Liability

In the unlikely event of a complete photographic failure or cancellation, the maximum liability of either party is limited to the total value of the contract.

15. Complaints

Any complaints should be raised by the client with Meg Cahill Photography, in writing, within 28 days of first becoming aware of the issue.

Booking Policy

Securing Your Booking: To confirm your session, a non-refundable deposit of 50% of the total fee is required within 7 days of booking, along with a completed booking form. Bookings are not confirmed until both are received. The remaining balance is due 48 hours prior to your session (excluding Weddings where remaining balance is due 6 months prior to wedding date or as otherwise agreed in writing).

Cancellation Policy: More than 6 months’ notice: All payments (excluding the deposit) will be refunded. Within 3 months of the shoot: No refund is available. Less than 2 weeks before the event: No refund and an additional 50% of the contract value is due as compensation for loss of work.

 

Image Use: Unless requested otherwise, Meg Cahill Photography may use images from your session for promotional purposes, including portfolio, website, and social media.

​

Creative Control: All sessions are captured with a natural, storytelling style. While client requests are welcomed, final decisions on styling, posing, and selection of images are made at the photographer’s discretion to best represent the session.

​

Delays or Emergencies: If Meg is unable to attend due to illness or unforeseen circumstances, a trusted replacement photographer may be arranged. In the event of complete cancellation due to force majeure, liability is limited to the total amount paid.
